Air Canada Flight Attendants Defy Back-to‑Work Orders, Strike Enters Fourth Day

Union defies federal orders: Over 10,000 Air Canada flight attendants, represented by the Canadian Union of Public Employees (CUPE), continue their strike despite being ordered back to work by the Canada Industrial Relations Board a move the union calls both unconstitutional and harmful to fair labor rights. Legal risks loom. Union leaders are prepared to face jail time and mounting fines rather than comply, underscoring their resolve to secure better wages and compensation for unpaid work. Widespread disruptions:
The walkout, already in its third to fourth day, has grounded all Air Canada and Air Canada Rouge operations, affecting an estimated 130,000 to 500,000 passengers daily and leaving travelers stranded globally. The Canada Industrial Relations Board deemed the strike illegal and issued back to work orders under Section 107 of the Canada Labour Code, enforced by the federal labor board. But CUPE defiantly refused to comply, demanding a fair negotiated agreement rather than forced arbitration.
Jobs Minister Patty Hajdu invoked Section 107 to compel arbitration, citing economic disruption. The opposition from CUPE stems from what they perceive as governmental overreach hindering collective bargaining.
CUPE argues that this intervention undermines charter rights and threatens fair labor practices echoing concerns over the union’s ability to negotiate meaningful terms.
CEO Mike Rousseau described the union’s defiance as “amazing” and damaging to both customers and the brand. The airline has suspended its 2025 financial guidance amid the continuing disruption.
Meanwhile, leaders across Canada’s labor movement including the Canadian Labour Congress and Unifor have rallied behind CUPE, criticizing the government’s back to work action as anti-worker and unacceptable.
